Job Description:

The Employee Relations Business Partner (ERBP), with the support of the Field HR Generalists, will be responsible for resolving employee relations in a manner that is effective, empathetic, neutral, fair and in support of RAC’s values of Honesty, Fairness and Respect and HR Strategy. Under the direction of the Director, Field Human Resources, the ERBP will design and implement large-scale policies and programs aligned with RAC’s “Workers Come First” philosophy, ensuring employees’ concerns are addressed timely and appropriately. The ERBP will directly oversee investigations in a manner that leverages best resolution practices and reduces business risk, while ensuring consistency, fairness, effectiveness, proper documentation and timely follow-up. The ERBP will develop and foster productive relationships with the HR and Operations teams at all levels and will act as an advisor and trainer. In addition, the ERBP will identify training needs, areas of opportunity, recommend/implement training and other strategies to minize legal exposure, and ensure all employees have the knowledge to prevent/mitigate legal conflicts at the field. The ERBP must be knowledgeable in CA and federal legal field including expertise in employment law, ALRA, Union Environment, DOL, FMLA/CFRA Mandated Leaves, ADA/FEHA, and Wage Order 14. The ERBP will be responsible for developing a process to effectively manage employee relations issues, which encourages employees to come forward with concerns and suggestions. This process will also provide the employee with timely resolution along with follow-up to ensure implemented solutions are sustained. The position will be headquartered in Oxnard, CA, USA and will report to the Director of Field Human Resources. Responsibilities IncludeEmployee Relations: Conduct or oversee effective internal investigations, of varied levels of complexity and risk exposure, in response to complaints/concerns submitted by field employees. Investigations should reflect best practices, Company’s values, and should adhere to legal and policy requirements. Leads ongoing open dialogue with field employees, business leaders, and Partners and drives effective resolutions to workplace issues. Follow established process to resolve workplace conflicts by conducting investigations that are consistent throughout California districts. Accountable for case management, progress reporting and document tracking for internal investigations. Provide complainants with a timely resolution that is fair, neutral and demonstrates the employee’s concern was seriously considered and employee feels valued and respected. Advise HR Generalists and oversee investigation process, ensuring established policies and procedures are followed adhering to the company’s values of Honesty, Fairness and Respect. Issue reports on all investigations conducted, present these reports to management and provide recommendations. Advise managers on how to effectively work with employees, especially in difficult situations. Coaches, guides and empowers field Supervisors and employees on preventive/proactive ways to address various issues including:• Policy interpretation• Policy violations• Performance management• Leaves of absence• Reasonable accommodations Serve as an objective third party in reviewing/recommending terminations and disciplinary actions. Review challenged termination decisions and disciplinary decisions for fairness, consistency and potential legal liability Legal Claims Management and Prevention Strategies:Conduct analysis of investigation case data to recognize and report trends monthly, quarterly and at year end. Design strategies, processes for preventing similar issues in the future. Utilize high-level judgment and risk recognition skills to appropriately identify and estimate legal and reputational risk. Support the Director of Field Human Resources with decisions regarding legal claims and strategies to minimize legal exposure. Analyze and protect highly confidential and sensitive information with the appropriate level of discretion. Develop business relationships with organizations which may be involved in legal complaints including ALRB, DOL, EEOC, OSHA, CRLA, Labor Commissioner. Advise Director Field HR regarding status of complaints, grievances, and other labor relations matters. Make recommendations on the revision or updates of company policies to support continued enhancement of work environment. Attend seminars, workshops, training sessions and other educational opportunities to stay current on legal requirements and HR best practices. Training:Identify areas of opportunity at the field level and design, implement training programs to address areas of concern. Develop training programs designed to educate supervisors in the areas of Wage and Hour, ALRA, Union Environment and Conflict Resolution. Partner with District HRBPs and Operations leaders to deliver trainings. Develop and track outcome measures. Ensure Field HR team has the necessary knowledge and tools to conduct effective investigations. Develop and implement training program. Ensure field supervisors have the tools, skills and training to resolve conflict at the field level. EDUCATION AND EXPERIENCE:• Bachelor’s degree in Human Resources, Business, or related field, or an equivalent combination of education and experience required.• Minimum 5 years’ experience in Human Resources with a specific focus on Employee Relations Investigations and knowledge of state and federal labor laws required. • Certified in Internal Investigations strongly preferred.• Ability to build strong partnerships and work closely with line managers, senior leadership and HR colleagues.• Knowledge of state and federal labor laws as they apply to agriculture• Fluency in both verbal and written English and Spanish required.• Must demonstrate outstanding stewardship and relationship building/management skills to expand the mission of Reiter Affiliated Companies.• Proven ability to effectively organize, prioritize and handle multiple assignments simultanously.• Knowledge and experience of the farming industry and issues preferred.• Proficient using standard office software such as Word, PowerPoint, Excel, Outlook.• Valid CA Driver License. Travel RequirementsAbility to Travel 20 percent of the time – California Districts.
